专利申请注意事项

专利申请前,最好进行检索,以便确定哪些发明内容属于"现有技术"。如果待申请的内容在检索到的专利文献或者其他公开出版物上已有记载,则有可能影响申请的授权前景。此外,即使没有文献记载,如果他人能够确定这是本领域的公知常识,也会导致专利申请被驳回。

首先应该鉴定那个发明专利是否授权,如果没授权也就没有侵权纠纷这一说;退一步说,假如那个专利授权了,你根本就没有使用这个方法从事经营活动,也就不存在侵权,纯学术研究不在侵权范围内哦

发明专利现在一般都要两到三年才能审批下来通过,我觉得你这个时间段可以同时考虑其他的途径,多查看下相关政策。论文题目和专利相似度高的话没有什么影响,我建议你可以先发论文。因为专利流程较久。或者也可以先申报一个实用新型专利,这样也算做保障。
